DMCA Policy

DrumSM respects the intellectual property rights of others and expects its users to do the same. As part of our commitment to protecting copyright holders and complying with the Digital Millennium Copyright Act (DMCA), we have implemented the following policy regarding the removal of infringing content.

Reporting Copyright Infringement

If you believe that your copyrighted work has been used on DrumSM’s website or mobile application in a way that constitutes copyright infringement, please notify us by providing the following information:

  1. A description of the copyrighted work that you claim has been infringed.
  2. Identification of the material that you claim is infringing and needs to be removed, including a URL or other specific location on the DrumSM platform where the infringing material is located.
  3. Your contact information, including name, address, telephone number, and email address.
  4. A statement by you that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  5. A statement by you, made under penalty of perjury, that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Counter-Notification

If you believe that material you posted on DrumSM’s platform was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. The counter-notification must include the following:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  2. Your name, address, telephone number, and email address.
  3. A statement under penalty of perjury by you that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, for any judicial district in which DrumSM may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Repeat Infringers

DrumSM reserves the right to terminate user accounts that are determined to be repeat infringers of copyrighted content.
